Certifying Radio Frequency Devices in the Customs Union
EAC covers the whole Customs Union, but radio spectrum does not. Why wireless products need national approvals, and why the module is never the thing approved.
For EAC certification Belarus is one of five doors into the same system. A legal entity registered in Belarus, your importer or an authorised representative under contract with you, applies to a Belarusian body for a certificate or registers a declaration under a technical regulation of the Union. The document is the same one issued anywhere in the Eurasian Economic Union: same regulations, same schemes under EEC Council Decision No. 44 of 18 April 2018, same EAC mark, valid in Russia, Kazakhstan, Armenia and Kyrgyzstan without a further procedure. The national body is the State Committee for Standardization of the Republic of Belarus, Gosstandart; its accreditation centre, BSCA, decides which bodies and laboratories may take your product.
Yes, on one condition. A certificate or declaration under a technical regulation of the Union is valid in all five member states, wherever it was issued. The condition is the body: it must be accredited in Belarus and listed in the Unified Register of Conformity Assessment Bodies of the Eurasian Economic Union, whose Belarusian part BSCA compiles. A body outside that register can print a certificate, and no customs officer in the Union will accept it. What does change is who checks what. The Commission adopts the regulations and the schemes; accreditation and state supervision of compliance stay with each member state, as joint work with the Commission's Department for Technical Regulation and Accreditation. A certificate for a pump issued through a Belarusian body is checked in Almaty against the same Union list, and passes if the body is there and its scope covers the product.
Scope is where a first project goes wrong. A body is accredited for named regulations and product groups, and the scope is printed in the BSCA register. The mistake we see is a body chosen for its name whose scope covers TR CU 010/2011 on machinery and stops short of TR CU 004/2011 on low-voltage equipment; the machine is mains-powered, and the second certificate has to come from a second body. Read the scope before the contract.
A legal entity or individual entrepreneur registered in Belarus: the importer, or an authorised representative appointed by the manufacturer under a contract. A foreign manufacturer cannot apply alone anywhere in the Union; EEC Council Decision No. 41 of 20 March 2018 applies the same rule to declarations. The applicant holds the document and answers to the surveillance authority if a batch fails. Where you have no Belarusian company we act as that applicant; the representation page sets out what the appointment obliges on each side.
The applicant shapes what happens at the border, and the border can be in another member state. A consignment shipped to a Russian buyer under a certificate held by a Belarusian trading company is valid, and the customs officer still asks how the importer on the customs declaration relates to the applicant on the certificate. We answer that with the contract chain and the manufacturer's authorisation, prepared before the goods leave.
The same care applies to the samples. They must enter Belarus under a customs procedure that allows them to be used for testing, and the laboratory asks for the customs paperwork before it opens the crate. A parcel marked "no commercial value" is refused there, and the second sample waits for the next laboratory slot. Ask before you ship the first crate.
Gosstandart, the State Committee for Standardization of the Republic of Belarus, is the national body for technical regulation, standardization and conformity assessment, and it publishes the STB standards. Under it sits the Belarusian State Centre for Accreditation, BSCA, the national accreditation body under Law No. 437-Z of 24 October 2016 on assessment for compliance with technical requirements and accreditation of conformity assessment bodies. BSCA accredits the testing laboratories and the product certification bodies, publishes both registers, and feeds the Belarusian part of the Union register.
The certification body does the work you pay for: it takes the application, sends the samples to an accredited laboratory, inspects the factory where the scheme requires it (scheme 1c for serial production), issues the certificate and registers it. For an EAC declaration Belarus follows the Union procedure of Decision No. 41: the applicant signs on its own evidence or on accredited-laboratory tests, and registers the declaration before the goods ship. The registration number is what a buyer or a customs officer checks.
The failure mode here is the declaration bought without tests. Registered under a scheme that requires accredited-laboratory tests, with no reports behind it, it is void the day an inspector asks for them. The seller is gone by then and the applicant, your importer or your representative, carries the fine and the recall. We register declarations only on reports we can produce on request.
What the Union regulations do not cover falls under Belarusian national conformity assessment, governed by the same Law No. 437-Z, against national STB standards. Energy efficiency of household appliances is the example we meet most: seven STB standards, from refrigerators to external power supplies, were reissued in 2020, and where the standard names the European regulation, as STB 2248 does for standby power under EC Regulation 1275/2008, technical documentation is the route. Radio equipment sits under the national regulation TR 2018/024/BY on telecommunication equipment, with a declaration or a certificate, and Belarus sometimes allows testing of the embedded module alone, decided case by case.
The timeline for the EAC part is the Union timeline: three to eight weeks for a typical product, driven by the laboratory schedule and by how fast the manufacturer supplies usable technical documentation. A serial certificate runs up to five years with annual inspection control above one year; a batch certificate under scheme 3c covers one consignment and needs no inspection. Manufacturers choose a Belarusian applicant for two reasons: the document is a Union-wide EAC certificate for Belarus and its four partners alike, and the BSCA register lists bodies and laboratories whose scopes cover the common industrial regulations, so the whole procedure runs in one country. Whether it is the right route depends on where the goods clear customs and who holds the document afterwards.

The certificate is checked against the Union register, not against the country on the letterhead. A body missing from that register, or one whose scope stops short of your product, produces a document that fails the first check in any member state.
